§01 Introduction & Acceptance of Terms

Welcome to BitwareTunes (accessible at bitwaretunes.com, including our lossless streaming application at /music, Android APK, newsletters, and associated online services, collectively referred to as the "Services").

BitwareTunes is an independent record label and sovereign synthetic audio platform operated by BitwareLabs, based in Skåne, Sweden.

By accessing, browsing, registering an account on, or streaming audio from BitwareTunes, you agree to be bound by these Terms of Service ("Terms") and our DMCA & Copyright Policy. If you do not agree to these Terms, you must immediately discontinue use of the Services.

§02 Definitions

• "Label", "We", "Us", or "Our": BitwareTunes and BitwareLabs.
• "User", "You", or "Your": Any individual or legal entity accessing or using the Services.
• "Catalogue": All musical works, sound recordings, compositions, master recordings, metadata, and sleeve artwork published by BitwareTunes, comprising:
  • In-House Releases (BW·* / BW·STUDIO): Sovereign AI-composed, generated, and DSP-mastered releases (e.g. Dva Brata, Zvekor, Osagt, Cumbión Dormido, LUNA, Silicon Babylon, Static Revolt, Neural Tides).
  • Open Stage Releases (OS·*): Releases created or submitted by independent creators signed to the BitwareTunes Open Stage catalog (e.g. L’Via Bell, Mea., Eva Lunella, Hartvinsky, Astral Allies, Southern Grit Revival, Opak, Rosyclémerson dos Santos Silva).
• "The Player": Our web and Android audio streaming software located at bitwaretunes.com/music.
• "The Dispatch": The official BitwareTunes intelligence newsletter and release bulletin.

§03 User Accounts & Eligibility

Age Requirement: You must be at least 13 years old (or the minimum legal age in your jurisdiction) to create an account or subscribe to our newsletter.

Account Creation: Registration on The Player requires a valid email address and password verification. We do not require invasive social logins or tracking permissions.

Account Security: You are responsible for maintaining the confidentiality of your credentials and authentication tokens. Any action performed through your verified session is deemed your responsibility.

Account Termination: You may delete your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms, engage in automated service abuse, or attempt unauthorized stream manipulation.

§04 License to Stream & Permitted Use

Personal Listening License: BitwareTunes grants you a personal, non-exclusive, non-transferable, revocable, and royalty-free license to stream audio published on The Player for personal, non-commercial listening.

Lossless Quality: Audio is streamed in high-fidelity 24-bit/48kHz or uncompressed master streams where supported.

No Commercial Re-broadcast: Streaming audio through BitwareTunes does not grant public performance, commercial broadcast, synchronization, resale, or sublicensing rights without a separate written licensing agreement from the Label or the respective Open Stage artist.

§05 Sovereign Synthetic Audio Disclosure & Intellectual Property

Transparency Disclosure (EU AI Act & Transparency Standards): BitwareTunes openly acknowledges and champions the use of artificial intelligence in contemporary music creation. Works in the In-House Catalogue are engineered using sovereign open-weights foundation models (including YuE 2), custom lyric craft, procedural prompt architecture, and offline hardware-grade broadcast DSP mastering.

Label Master Ownership: All rights, titles, and interests in the In-House Catalogue (BW·*), website design, branding, visual sleeves, sound recordings, DSP mastering chains, and software codebases remain the exclusive property of BitwareTunes / BitwareLabs.

No Deceptive Human-Posing: BitwareTunes does not engage in ghost-producing or deceptively marketing purely synthetic performances as traditional live un-augmented human recordings.

§06 Open Stage (OS·*) Roster & Direct Fan Support

Open Stage Creator Warranties: Artists submitting music to the Open Stage program warrant and represent that they own or hold all required licenses, clearances, and authorizations for all musical elements, vocal models, lyrics, and recordings submitted.

100% Direct Fan Support: BitwareTunes believes in transparent artist compensation:

• For all signed Open Stage releases (OS·*), direct fan support links (such as the artist's personal PayPal, Bandcamp, or direct store) go 100% directly to the respective artist.
• BitwareTunes takes zero commission, zero transaction fees, and zero percentage from direct fan contributions to Open Stage artists.
• BitwareTunes operational support links (such as Label Ko-fi) are strictly excluded from Open Stage releases and profiles so they cannot be mistaken for artist donations.

§07 Prohibited Conduct & AI Dataset Protection

To protect our sovereign roster, infrastructure, and signed artists, the following activities are strictly prohibited:

• Stream Ripping & Mass Scraping: Extracting, mass-downloading, stream-ripping, or bypassing token-protected stream delivery endpoints (/_protected_audio/) using unauthorized scripts, spiders, scrapers, or browser extensions.
• Unauthorized AI Model Training: You may not use any audio recordings, stems, lyrics, or sleeve art from the BitwareTunes Catalogue to train, fine-tune, or calibrate third-party machine learning models, voice clones, or commercial AI systems without explicit, signed commercial licensing from BitwareTunes.
• Reverse Engineering & Service Disruption: Probing, scanning, or attacking our WireGuard networks, internal admin systems, SMTP servers, rate-limiting layers, or streaming servers.
• Commercial Piracy: Re-uploading BitwareTunes releases to third-party digital service providers (Spotify, Apple Music, YouTube Content ID, etc.) for commercial monetization without authorization.

§08 The BitwareTunes Dispatch (Newsletter)

Opt-In: Subscription to The Dispatch is voluntary via website forms, player opt-ins, or account registration.

Content: Dispatches provide technical essays, audio engineering research, model benchmarks, and release notices.

One-Click Unsubscribe: Every email sent by BitwareTunes includes a direct, RFC 8058-compliant one-click unsubscribe header (List-Unsubscribe=One-Click) and a prominent unsubscribe link. Unsubscribing takes effect immediately across our database.

§09 Copyright Claims & DMCA Notice-and-Takedown

BitwareTunes respects legitimate intellectual property rights while rejecting automated copyright trolling.

If you believe a sound recording on our service infringes your copyright:
• You must comply with our strict Technical Proof Standard as set forth in our DMCA & Copyright Policy.
• Submissions must provide verifiable, timestamped project files, stems, or registered ISRC certificates to demonstrate genuine prior ownership.

§10 Disclaimer of Warranties

The Services and Catalogue are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.

BitwareTunes does not warrant that audio streaming will be uninterrupted, error-free, or compatible with every legacy browser or hardware setup. We reserve the right to modify, pause, or update player features, release catalogs, or backend infrastructure without prior liability.

§11 Limitation of Liability

To the maximum extent permitted by Swedish and European Union law:

1. In no event shall BitwareTunes, BitwareLabs, its founders, contractors, or artists be liable for any indirect, incidental, special, punitive, or consequential damages arising from the use of or inability to use the Services.

2. In all cases, our total aggregate liability to you for any claim arising out of these Terms shall not exceed the amount actually paid by you to BitwareTunes (if any) in the twelve (12) months preceding the claim, or 500 SEK, whichever is greater.

§12 Privacy & Data Protection (GDPR)

Your privacy is paramount:
• We collect minimal telemetry necessary to operate lossless streaming, prevent playback abuse, and manage newsletter delivery.
• We do not sell user data, tracking cookies, or listening profiles to third-party advertising networks.

§13 Governing Law & Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the substantive laws of Sweden, without regard to conflict-of-law principles.

Any dispute shall be subject to the exclusive jurisdiction of the district court of Malmö, Sweden (Malmö tingsrätt), except where mandatory EU consumer protection regulations grant jurisdiction to the consumer's local court of residence.

§14 Modifications to Terms

BitwareTunes reserves the right to amend these Terms as technology, copyright regulations, and model capabilities evolve. Material changes will be noted on this page with an updated "Last Updated" date and announced via The Dispatch. Continued use of the Services following an update constitutes acceptance of the modified Terms.
