§01 Scope & Applicability
This Agreement applies to all artists, songwriters, producers, and creators who submit musical works to or are signed under the BitwareTunes Open Stage catalogue sequence (designated by catalog numbers beginning with OS·*).
Contributing acts include our founding roster: L’Via Bell (OS·001), Mea. (OS·002), Eva Lunella (OS·003), Hartvinsky (OS·004), Astral Allies (OS·005), Southern Grit Revival (OS·006), Opak (OS·007), Rosyclémerson dos Santos Silva (OS·008), and all subsequent Open Stage additions.
§02 Non-Exclusive Streaming License & Full Creator Ownership
- You Retain 100% Ownership: You retain complete, unrestricted copyright ownership of your master recordings, compositions, arrangements, lyrics, and artwork. Signing an Open Stage release does not assign or transfer your copyright to BitwareTunes.
-
Non-Exclusive License: You grant BitwareTunes a non-exclusive, worldwide, royalty-free license to host, stream, transcode, catalog, and promote the accepted release across our web player (
bitwaretunes.com/music), Android application, promotional dispatches, and public archives. - Freedom to Distribute Everywhere: Because this license is strictly non-exclusive, you remain 100% free to distribute your music on Spotify, Apple Music, Bandcamp, physical vinyl, or with any other label, aggregator, or publisher at any time.
§03 100% Direct Fan Support (Zero Commission)
Unlike conventional labels and streaming aggregators that extract platform cuts:
- Direct Fan Payments: Artist profiles on BitwareTunes feature prominent direct fan support links provided by the artist (such as your personal PayPal, Bandcamp, Buy Me A Coffee, or store).
- Zero Label Deduction: BitwareTunes takes 0% commission, 0% middleman cut, and $0 transaction fees from direct fan donations to Open Stage artists. 100% of fan contributions transfer directly from your supporters to your account.
- Label Ko-fi Segregation: In accordance with label policy, BitwareTunes operational support links (such as Label Ko-fi) are strictly barred from appearing on Open Stage artist cards and release sleeves so they cannot be mistaken for artist donations.
§04 Official Catalog Sequencing & Discography
Upon acceptance of an Open Stage submission (minimum 5-track concept EP or album):
• We assign the release an official, permanent Open Stage sequence code (e.g. OS·007, OS·008).
• The album is rendered with official BitwareTunes spine packaging, metadata formatting, and dual-language (English / Swedish) artist profiles.
• The release is permanently archived across our streaming player infrastructure and featured in The BitwareTunes Dispatch.
§05 Audio Mastering & DSP Standards
BitwareTunes is committed to audiophile broadcast dynamics. When requested or required for acoustic coherence, your submitted masters may be processed through our offline broadcast DSP chain targeting:
• Integrated Loudness: -14.0 LUFS (EBU R128 standard).
• True Peak Ceiling: -0.8 dBTP True Peak headroom to eliminate inter-sample clipping on lossy mobile DACs.
• Lossless FLAC Hosting: Original uncompressed 24-bit masters are archived and served without lossy dynamic range flattening.
§06 Creator Warranties & Provenance
As a contributing Open Stage creator, you warrant and agree that:
- You have the legal authority to enter into this Agreement and license the submitted audio and visuals.
- The musical works and lyrics are your own original creations or generated through models where you hold valid commercial/user creation rights under the respective model's terms of service (e.g. Suno, Udio, YuE 2, local sovereign weights).
- Your recording does not incorporate unauthorized, uncleared samples from copyrighted commercial masters or deceptive voice clones of living artists without consent.
- You will provide accurate AI tooling declarations (models, prompts, DAW plugins used) for transparency in our catalog archive.
§07 Voluntary Exit & Takedown Procedure
We believe artists should never feel trapped in a record contract:
If you ever decide to remove your release from BitwareTunes (for example, if you sign an exclusive major-label contract requiring exclusivity), you may request a takedown at any time by sending a written notice from your registered artist email to hello@bitwaretunes.com.
Upon receipt, BitwareTunes will remove the audio files and streaming endpoints from The Player within 30 calendar days. Your catalog sequence designation (e.g., OS·007) will be honorably archived.
§08 Governing Law
This Agreement is governed by and construed in accordance with the substantive laws of Sweden. Any dispute arising out of or in connection with this agreement shall be settled in the district court of Malmö, Sweden (Malmö tingsrätt).
